Agreement
These terms are the agreement between you and My Own Company Oy Ab (business ID 3434307-9), Turku, Finland, about Moi Calendar: the app on iOS, Android and the web, and the services behind it. By using Moi Calendar, you agree to them. The Privacy Policy explains how we handle personal data.
Using Moi Calendar without an account
Moi Calendar works without an account, free of charge. Everything you create is stored on your device. Without an account there is no other copy, so if the device is lost, broken or reset, or the app is removed, we cannot recover what was on it.
Accounts
An account adds sync, backup and sharing. To create one, you must be old enough to agree to these terms and to the processing of your personal data yourself where you live (13 in Finland). An account is for one person.
You sign in with Apple, Google or a code we email you, so keep those safe. You are responsible for what happens in your account. We use your email address for sign-in and for important notices about your account.
Features and plans
Some features of Moi Calendar are free, and others are part of a paid plan. Before you choose a plan, we show you its price and what it includes, and nothing is charged without you choosing it. If a free feature you use is going to become paid, we will tell you in advance. Using Moi Calendar on your device without an account stays free.
We may offer some features as a preview or an early version. These may change, may be open only to some people, and may end, and we provide them as they are.
- Purchases are made through Apple, Google or Stripe, under their terms. Refunds follow their policies and your rights under consumer law.
- A subscription renews until you cancel it.
- If a subscription ends, syncing stops. The app and the calendars on your devices keep working, and we keep the copy on our servers for a limited time, as the Privacy Policy describes.
- Sync has no fixed storage limit for personal use.
Personal and organisation use
Personal accounts are for personal, non-commercial use: your own calendars and those of your household, family and friends. Using Moi Calendar on behalf of an organisation, such as a school, daycare, care provider, therapy practice or business, or in your work with the people you support, needs an organisation plan or a separate agreement with us. If an account is used this way, we may ask you to move to such a plan and, after giving notice, limit or end that use.
Your content
What you put in Moi Calendar stays yours. You give us permission to store, copy, back up, process (for example, make smaller versions of pictures and videos), sync and show your content to you and to the people you share it with, only as far as we need to run Moi Calendar. That permission ends when you delete the content or your account, apart from copies in backups, which are removed as those backups expire.
Add only content you have the right to add. If you add pictures, recordings or information about other people, including children, you are responsible for having their permission, or their parent's or guardian's.
Sharing
You decide who can see a calendar and who can change it. People you invite see what is in it, and each member's name, profile picture and email address. Depending on the role you give them, they can add, change or delete things in it. You can remove someone at any time, but what they have already seen or saved outside Moi Calendar is beyond our control.
Acceptable use
Do not use Moi Calendar to:
- break the law or infringe anyone's rights;
- harm, harass or exploit anyone, and children in particular;
- upload malicious software, or content you have no right to share;
- get into accounts or data that are not yours, or probe or break our security;
- overload or disrupt the service, or access it by automated means other than the app and the website;
- copy, resell or reverse-engineer Moi Calendar, except as the law allows.
Moi Calendar itself
The Moi Calendar app, its name, design and software belong to us. We give you a personal, non-transferable right to use Moi Calendar under these terms. If you got Moi Calendar from the App Store or Google Play, their terms also apply to your download.
Changes and availability
We keep improving Moi Calendar, so features change over time. We work to keep sync running, but we cannot promise that it will always be available or free of errors: maintenance, outages and events outside our control happen. The app and the calendars on your device work without a connection. If we ever stop offering sync, we will give you reasonable notice and a way to keep your calendars on your device.
Ending
You can stop using Moi Calendar at any time, and delete your account in the app (Settings › Account › Delete account) or on the web.
We may suspend or close an account that seriously or repeatedly breaks these terms, when the law requires it, or to protect other people or the service. Where we reasonably can, we will tell you first and give you the chance to put things right and to keep your calendars on your device.
Liability
We make Moi Calendar with care. To the extent the law allows, we provide it as it is and as available, without promises beyond those in these terms. We are not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control. To the extent the law allows, our total liability to you is limited to the greater of what you paid us for Moi Calendar in the 12 months before the claim, or 100 euros.
None of this limits your statutory rights as a consumer, or our liability where the law does not allow it to be limited, such as for intent, gross negligence, or death or personal injury.
Changes to these terms
We may update these terms. If a change matters to how you use Moi Calendar, we will email account holders at least 30 days before it takes effect. If you don't agree, you can delete your account before then (in the app: Settings › Account › Delete account, or on the web). Changes take effect on the date shown at the top of this page.
Governing law and disputes
These terms are governed by the laws of Finland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
If something goes wrong, tell us first at myowninteractions@gmail.com; most things can be put right that way. If you live in Finland, you can also take a dispute to the Consumer Disputes Board (kuluttajariita.fi). Consumers elsewhere in the EU can get help from the European Consumer Centre in their country. Disputes go to the competent court in Finland, or, if you are a consumer, you may also use the courts where you live.
General
If part of these terms turns out to be invalid, the rest still applies. We may transfer these terms to a company that takes over Moi Calendar, and your rights under them stay the same.
